COVID-19 is not something we can control. Participation in Cantus Youth Choirs is at your own risk! We cannot guarantee you won’t be infected. You accept all responsibility and agree to follow all indicated safety protocols.

No refunds. Once you register, you’re on the hook. So please make sure you’re ready to join. The Cantus Board can issue refunds in extreme cases.

You can miss 3 rehearsals. We don’t need to know why you missed, just limit absences to 3 … unless you’re sick. And if you’re sick, stay home and get better.

Videos and photos belong to Cantus. You give us permission to take photos and videos of your child at Cantus events and use them to promote Cantus. You will not be compensated for this.

We’ll do our best to save your kid if there’s an emergency. We’re going to call 911 and get medical care for your child. We won’t pay for any of the bills.

We collect information. Your email address, credit card information, and children’s names are safe. We don’t sell your information to anyone. And you can unsubscribe from our communication channels at any time (you won’t have any clue of what’s going on, but you could).

We need to get a hold of you. We collect email addresses and cell phone numbers from you and your singers so that we can send email and/or text messages (SMS/MMS). Message and data rates may apply. Message frequency varies.

Coranavirus/COVID-19 Waiver of Liability and Indemnification

I acknowledge the contagious nature of the Coronavirus/COVID-19.

I further acknowledge that Cantus Youth Choirs can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Cantus staff, and other participants and their families. 

I voluntarily seek services provided by Cantus Youth Choirs and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while participating.

I hereby release and agree to hold Cantus Youth Choirs harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of Cantus Youth Choirs, or that may otherwise arise in any way in connection with any services received from Cantus Youth Choirs. I understand that this release discharges Cantus Youth Choirs from any liability or claim that I, my heirs, or any personal representatives may have against Cantus Youth Choirs with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Cantus Youth Choirs. This liability waiver and release extends to Cantus Youth Choirs together with all owners, partners, and employees.
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my participation with Cantus Youth Choirs whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.

Photography, Videography, Audio Recording Release

I grant permission for my child/ward to be photographed and/or video/audio recorded in conjunction with Cantus activities/performances and the possible subsequent promotional use thereof. I agree to no compensation for these recordings, except as may be agreed to in a signed writing in advance for specified projects, regardless of payment or other benefits to Cantus and hereby release all claims against Cantus with respect to such recordings related compensation.

Medical Release

I authorize Cantus, its officers, employees, and agents to secure the services of emergency transportation, health providers, emergency workers, hospitals and other related persons and facilities on behalf of my child/ward in the unlikely event of an accident, illness or other exigent circumstances, and I assume responsibility for related expenses and will provide payment or repayment to Cantus of such expenses. I further give permission to Cantus, its officers, employees and agents to provide over-the-counter medicines (eg: Tylenol, Tums, Ibuprofen, Dramamine, etc) to my child/ward as deemed necessary by Cantus or by appropriate emergency or medical personnel.

Financial Policy

I agree to promptly pay the required fees for my child/ward to participate in Cantus Youth Choirs. I understand that these fees and payment due dates are detailed in the financial section of the Handbook (www.cantusyouthchoirs.com/handbook) as they apply to the specific ensemble to which my child/ward is assigned and accepts membership.

I understand and agree that I am making a financial commitment to pay for the entire season even if my child/ward withdraws from or otherwise fails to participate in Cantus for all or any part of the season and will provide payment on a timely basis. I further agree to pay any additional fees that may arise during the season based upon uniform needs, travel, and training opportunities that may apply to my child/ward. Such additional fees will be communicated to me by Cantus via statements of account for my child/ward. All such additional fees will be due and payable as reflected in the related statements of account or otherwise provided by Cantus.

The www.cantusyouthchoirs.com website (the “Site”) is comprised of various web pages operated by Cantus Youth Choirs. www.cantusyouthchoirs.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Cantus Youth Choirs is a website where parents can register their children to participate in a non-profit community choir. Participants pay tuition to participate and must provide the required information. Participants may also opt in to come on tour. The site also facilitates learning in rehearsal by providing practice file downloads and other news and information.

Privacy

Your use of www.cantusyouthchoirs.com is subject to Cantus Youth Choirs’s Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Cantus Youth Choirs agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. Termination/Access Restriction

Cantus Youth Choirs reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. Cantus Youth Choirs’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Cantus Youth Choirs’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Cantus Youth Choirs with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
